Terms of Service

These terms are the agreement between you and Lux Monsters. By browsing this site, joining the waitlist, or placing an order, you accept them. If you do not, close the page.
Eligibility
You must be at least 18 years old to buy from us. You must also be resident in a country that is not on the European Union, United States, United Kingdom, or United Nations sanctions lists. If you are acting for a business, you confirm you have authority to bind it.
How an order is formed
When you place an order, you are making an offer to buy. The contract is formed only when we send you an order confirmation email with a serial number and production slot. We may refuse any order, including where stock is limited, where we cannot verify the buyer, or where we suspect fraud. If we refuse, we refund any payment in full.
Pricing
All prices are listed in euro. Prices shown on the site do not include customs duties, import taxes, or local VAT outside the European Union. These are your responsibility. We may change prices at any time, but any change does not affect an order we have already confirmed.
Payment
Payment is taken in full at the time of order. We use Stripe to process cards. Card details go straight to Stripe and are never stored on our servers. If a payment fails or is reversed, the order is cancelled and we keep no stock reserved for you.
Production and delivery
Every Lux Monster is made to order. Production takes 4 to 8 weeks from the date we confirm your order. We ship from Paris by DHL or FedEx, fully insured, with signature on delivery. Shipping times vary by destination and we do not guarantee a specific delivery date. You are responsible for any customs duty, import tax, or broker fee charged on arrival.
Risk and title
We ship under Incoterm DAP (Delivered at Place). Risk passes to you when the piece is handed over for delivery at the destination address. Title passes once we have received full payment. Until then, the piece remains ours.
Authentication
Each piece ships with three linked proofs of origin: an embedded NFC chip, a laser-engraved serial number, and a signed certificate of authenticity. The NFC chip pairs with /verify on this site to confirm the piece is genuine. If the chip is altered, swapped, or removed, the authenticity guarantee is void and we cannot service the piece under warranty.
Warranty
Every Lux Monster carries a lifetime craftsmanship warranty. Full terms live on the /warranty page and are part of this agreement by reference. In short: we repair any defect in material or workmanship for as long as you own the piece, at our cost.
Consumer rights and the 14-day rule
EU consumers normally have 14 days to return goods bought online. Under Article 16(c) of EU Directive 2011/83/EU, this right does not apply to goods made to the consumer's specification or clearly personalised. Every Lux Monster is produced after your order and built to your specification, so the 14-day cooling off period does not apply. Your other statutory rights as a consumer remain fully in force, including the rights set out in French Consumer Code articles L217-3 and following.
Limitation of liability
Our total liability to you under or in connection with any order is capped at the price you paid for the piece. We are not liable for indirect or consequential loss, including loss of profit, loss of opportunity, or damage to reputation. Nothing in these terms limits liability for death, personal injury caused by our negligence, or any liability that cannot be limited under French law.
Intellectual property
All content on this site, including character designs, photography, text, video, code, and the Lux Monsters name and logo, is owned by Lux Monsters or licensed to us. You may view and share the content for personal, non-commercial use. Any other use, including reproduction, adaptation, or commercial display, needs our written permission.
Termination
We may suspend or cancel an account or order if we detect fraud, abuse, repeated chargebacks, or any behaviour that threatens staff or other customers. Where an order is cancelled after production has started for this reason, we may retain the value of work already done.
Force majeure
We are not liable for delays or failures caused by events outside our reasonable control, including strikes, customs holds, natural disasters, gem supply disruption, war, or public health emergencies. If a force majeure event lasts more than 90 days, either side may cancel the order and we will refund any amount paid for work not yet done.
Governing law and jurisdiction
These terms are governed by French law. Any dispute that cannot be resolved directly will be heard by the Tribunal de Commerce de Paris, without prejudice to any mandatory consumer protection rule that grants you the right to sue or be sued in the courts of your country of residence.
